2/4 conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.
Heard the learned counsel for the Appellants / petitioners and the learned A.P.P. for the State, Ms. Renu Kumari.
The present petition has been filed for correcting a typographical error, which has crept in the order dated 23.12.2020 passed in Criminal Appeal (SJ) No. 240 of 2020 to the extent that the village and Police Station of the Appellants / petitioners have been wrongly depicted in the memo of parties on account of the same having been wrongly depicted in the main petition.
The learned counsel for the appellants / petitioners has submitted that the appellants / petitioners are resident of village- Gopalpur Dumri, Police Station-Khaira, District-Saran at Chapra and not of village- Chaipali, Police Station-Jalalpur, hence this Court may modify the order dated
3/4 23.12.2020 passed in Criminal Appeal (SJ) No. 240 of 2020 to the said extent.
Having regard to the facts and circumstances of the case, it is directed that the address of the Appellants/petitioners, as mentioned in the memo of parties in the order dated 23.12.2020 passed in Criminal Appeal (SJ) No. 240 of 2020 be read as village- Gopalpur Dumri, Police Station-Khaira, District-Saran at Chapra.
At this juncture, the learned counsel for the appellants / petitioners submits that the appellants no. 1 and 3 to 6 have been granted the privilege of anticipatory bail vide order dated 23.12.2020 passed in Criminal Appeal (SJ) No. 240 of 2020 and were required to surrender before the learned court of Additional District and Sessions Judge 1st - cum- Special Judge, SC/ST (POA) Act, Saran at Chapra in connection with Khaira P.S. Case No. 249 of 2019, however, on account of the wrong address being depicted in the order dated
4/4 23.12.2020, they have not surrendered as yet, hence the time granted to the appellants / petitioners to surrender be extended by a further period of four weeks.
Considering the submissions made by the Ld.
Counsel for the appellants / petitioners, the appellants no. 1 and 3 to 6 are granted four weeks' further time to surrender before the learned court of Additional District and Sessions Judge 1st - cum- Special Judge, SC/ST (POA) Act, Saran at Chapra in connection with Khaira P.S. Case No. 249 of 2019, in order to avail the privilege of anticipatory bail.
The present petition stands disposed of with the aforesaid modification in the order dated 23.12.2020 passed in Criminal Appeal (SJ) No. 240 of 2020.
