JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-08-2015 Heard learned counsels for the petitioner and the State. The petitioner being Panchayat Mukhia is apprehending arrest in a case registered for the offences punishable under Sections 408,409,420 and 120B/34 of the Indian Penal Code. The accusation is of purchase of solar light by diverting the funds from other scheme and the purchase was made from the agency not authorized by BREDA or BELTRON.
It is submitted by the learned counsel for the petitioner that considering the fact that solar lights were purchased from Tata B P Company which is also incorporated in the list of authorized dealers, similarly situated accused persons have been granted anticipatory bail vide Cr. Misc. No.51739 of 2014 and analogous cases and Cr. Misc. No. 13342 of 2015.

No.32526 of 2015 (2) dt.10-08-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhojpur at Ara in connection with Bihiya P.S. Case No. 236 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
