JUSTICE PARTHA SARTHY ORAL ORDER 12-08-2021 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner has preferred the instant application for grant of regular in a case registered under sections 302 and 34 of the Indian Penal Code and section 27 of the Arms Act. As per allegations in the F.I.R., five named accused persons including the petitioner herein came to the house of the informant. On hearing the scream of her husband, it is stated by the informant that on waking up she saw accused Musafir Ravidas and Ashok Ravidas with pistol. All the accused escaped. She found her husband to have died as result gunshot injuries.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. Even

His case stands on a better footing then that of coaccused Musafir Ravidas who has been enlarged on bail vide order dated 10.6.2020 (Annexure-2). The petitioner is in custody since 14.9.2020 and has no criminal antecedent.

The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the grant of bail to coaccused and investigation in the having concluded, this Court directs the petitioner to be enlarged on bail in connection with Sessions Trial no.721 of 2019 (arising out of Masaurhi P.S. Case no.654 of 2018) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge, Patna/successor Court.
