JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-01-2015 The petitioner is languishing in custody since 31-3-2014 in a case registered under sections 399, 402 of the Indian Penal Code and 25(1-B)(a)/26/35 of the Arms Act.

On receiving information, the Inspector-cum-S. H. O.

Patna High Court Cr.Misc. No.33154 of 2014 (5) dt.09-01-2015 2 / 2 Raxaul P.S. conducted raid and on chase two miscreants, namely, Parvez Mian and Harendra Ram were apprehended who disclosed the name of the petitioner.

It has been submitted that no recovery was made from the possession of the petitioner. The petitioner is an accused in another case bearing Bathnaha P.S. Case No. 127 of 2007 in which he has been granted bail.

Considering the aforesaid facts, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Raxasul, East Champaran at Motihari in connection with Raxaul P.S. Case No. 171 of 2005.

The learned court below will be at liberty to cancel the bail bonds of the petitioner if he defaults for two consecutive occasions and gets substantially involved in some similar nature of offence.
