JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-06-2016 Heard learned counsels for the petitioner and the State. The petitioner being the mother of the husband of the victim is languishing in jail since 29.03.2016 in a case registered for the offences punishable under Sections 498A, 304B and 201/34 of the Indian Penal Code.

The prosecution case is of killing the sister of the informant within one year of the marriage for non-fulfillment of the dowry demand and disposing of the dead body. It is submitted by learned counsel for the petitioner that the accusation is omnibus and general against entire in-laws family and thrust of accusation is against the husband of the victim. The informant subsequently retracted from his initial version and filed a petition to that effect before the learned court

Patna High Court Cr.Misc. No.22762 of 2016 (3) dt.29-06-2016 2/2 below. During trial of husband of the victim, the informant has been examined who has not supported the prosecution case and also admitted that the victim died due to illness while treatment. Considering the fact that the investigation has already concluded and informant has not supported the prosecution case during trial of husband of the victim, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bettiah, West Champaran in connection with Majhaulia P.S.
