2. The petitioner apprehends arrest in connection with Patarghat P.S. Case No. 170 of 2024 instituted under Section 30(a) of the Bihar Prohibition and Excise Act.

3. There is recovery of 20 bottles each containing 100 ml. total 2 litres of illicit cough syrup was recovered from the house of the petitioner. Petitioner ran away from the place of occurrence. Though, the case is registered under excise act. But in my opinion, the provision of NDPS Act is also applicable.

4. Considering the same, this is not a fit case for grant of anticipatory bail.

5. Accordingly, the application stands dismissed.

6. If the petitioner surrenders within four weeks from today and prays for regular bail, the same shall be considered by the Court below in accordance with law without being prejudiced by the present order.
