The petitioners seek bail in a case registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code.

The driver of the truck disclosed that some persons were taking out diesel from the truck and on protest the accused

Patna High Court Cr.Misc. No.26704 of 2015 (2) dt.28-07-2015 2/2 persons assaulted the driver Raj Kumar Yadav, the driver of the truck and Vikash Kumar the assistant driver of the truck. The villagers disclosed the name of 15 accused persons. It is submitted that no specific allegation is made against the petitioners. Similarly situated co-accused Bhikhari Rai and Amit Kumar Singh @ Amit Kumar have already been granted bail. The case of the petitioners stands on the same footing as the informant on the basis of information given by the villagers disclosed the name of three persons including the petitioners but did not make any specific allegation.

Considering the facts aforesaid, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur/court concerned, in Motipur P.S. Case No. 16 of 2015.
