JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-03-2022 Heard Mr. Manoj Kumar, learned Advocate for the petitioner and Ms. Renuka Ratnakar learned A.P.P. The petitioner seeks bail in anticipation of his/her/their arrest in connection with Avtarnagar P.S. Case No. 241 of 2020 dated 01.10.2020 instituted for the offences under Sections 147, 323, 324, 341, 354, 379, 448, 307, 504, 506, 420 of the Indian Penal Code and Section 27 of the Arms Act. Though the petitioner is said to have exhorted her family members and also assaulted one of the victims but the injuries are found to be simple in nature. It is further submitted that there is no specific accusation of assault as against the petitioner.
The petitioner has also lodged a case against the
Patna High Court CR. MISC. No.16201 of 2021(2) dt.04-03-2022 2/2 Informant of the subject F.I.R. and others for the offence under Section 307 and other sections of the Indian Penal Code. There is a delay of ten days in lodging the F.I.R. Considering the aforenoted facts and taking into account the gender of the petitioner, she is directed to be released on bail, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on her furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Chapra, Saran in connection with Avtarpur P.S. Case No. 241 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
