The petitioner seeks bail in Agamkuan P.S. Case No. 99/2012 (G.R. No. 793/12) registered under Sections 25(1-B)2, 26, 27, 35 of the Arms Act and Sections 353, 307/34 of the Indian Penal Code.
The prayer for bail of the petitioner was earlier rejected vide order dated 08.07.2015 passed in Cr. Misc. No. 38934/2014 and even after lapse of more than a year the trial has not yet been concluded. A report was called for from the trial court and the learned Additional Sessions Judge IV, Patna City, who is in seisin of Sessions Trial No. 873/12, has reported that two witnesses are yet to be examined. The petitioner is in jail since 08.05.2012. All other accused persons, namely, Pankaj Kumar @ Pankaj Singh, Dhirendra Kumar @ Kakku Kumar, Jitu Upadhaya
Patna High Court Cr.Misc. No.22791 of 2016 (4) dt.30-11-2016 2/2 @ Gogo have already been enlarged on bail and the case of the petitioner stands on the same footing.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge IV, Patna City, Patna in S.T. No. 873/2012, arising out of Agamkuan P.S. Case No. 99 of 2012 (G.R. No. 793/2012). (Prabhat Kumar Jha, J) Dilip/- U T
