The petitioner has preferred this application for grant of regular bail in a case registered under section 302 and other sections of the Indian Penal Code.
As per allegations in the F.I.R., over a dispute relating to sale and purchase of eggs, it is stated that the three accused persons including the petitioner herein assaulted the brother of the informant with cycle chain etc. as a result of which he died on way to P.M.C.H., Patna.
It is submitted by learned counsel for the petitioner that the allegations as levelled in the F.I.R. are false and concocted. The petitioner has been falsely implicated in the case. There is case and counter case between the parties. The

No.16957 of 2021(2) dt.26-08-2021 2/2 contents of the post-mortem report which has been brought on record as Annexure-3 to the petition do not conform to the allegations levelled in the F.I.R. as only one bruise injury over the left eye has been found on the body of the deceased. The petitioner is in custody since 28.2.2020, he has no criminal antecedent and investigation in the case has concluded. Heard learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner together with the period in custody, the Court directs the petitioner to be enlarged on bail in connection with Lakhisarai P.S. Case no.52 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai.
