Learned counsel for the petitioner submits that the petitioner has moved this Court because the District Appellate Authority was not functioning at Madhubani. He has filed a case bearing No. 17/2022.

It is submitted that at this stage the District Appellate Authority is functioning, therefore, he would withdraw this writ

Patna High Court CWJC No.1889 of 2023(2) dt.20-06-2023 2/2 application to enable him to press the pending appeal before the District Appellate Authority, Madhubani.

Learned counsel for the State has no objection to the same.

This Writ Application is dismissed as withdrawn with liberty to the petitioner to press his appeal which is said to be pending before the District Appellate Authority, Madhubani. Let the District Appellate Authority, Madhubani consider the said appeal of the petitioner and all endeavours be made to decide the same preferably within a period of six months from the date of receipt/communication of a copy of this order.
