JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 20-05-2016 The petitioner apprehends his arrest in a case under sections 447,341,323,325,504/34 of the IPC and under the SC and ST Act. Learned counsel submits that the occurrence took place on 21.10.2011 and the FIF was lodged after three days on 24.10.2011. As per the FIR, accused persons abused the informant by calling his caste name and assaulted his daughter causing injury. Informant's daughter was examined on 24.10.2011. The doctor opined that the injuries were inflicted only 3 to 4 hours prior to the occurrence. Learned counsel submits that the report of the doctor casts a doubt on the prosecution case.

He submits that the instant case has been lodged as retaliation to earlier case instituted against the informant on 24.2.2011 by the petitioner.
