In this case, the petitioner is seeking regular bail in connection with Amnaur P.S. Case No. 361 of 2022, registered for the offences punishable under Sections 414 of Indian Penal Code and 30(a) of Bihar Prohibition and Excise Act, 2016. As per allegation, 321.8 liters of country made liquor was recovered from a hut and 60 liters of liquor was recovered from the possession of the petitioner. The learned counsel for the petitioner has submitted that he is under custody since 11.12.2022. He has also submitted that the hut wherefrom the alleged country made liquor was recovered does not belong to him.

No.6293 of 2023(2) dt.10-05-2023 2/2 Considering the above-mentioned facts and circumstances and period of custody, let the petitioner abovenamed be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 2nd cum 1st Exclusive Special Judge, Excise, Saran at Chapra/concerned court in connection with Amnaur P.S. Case No. 361 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
