02. In the present case, the petitioner seeks bail in connection with Ganga Bridge P.S. Case No. 250 of 2021 registered for the alleged offences under Sections 363, 366(A), 504 and 120(B) r/w 34 of the Indian Penal Code.

03. As per prosecution case, the 15 years old daughter of the informant went missing and the informant came to know about the petitioner and other co-accused persons who enticed away the daughter of the informant with intention of solemnizing marriage.

04. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.6579 of 2026(2) dt.04-02-2026 2/3 petitioner is innocent and has been falsely implicated in this case. There is no allegation of use of force, coercion, threat or violence attributed to the petitioner. The FIR has been lodged after delay of four days without any satisfactory explanation. The victim girl was in love with this petitioner and she solemnized marriage with the petitioner and they have a child out of this wedlock. The alleged victim is now major and has been living in the house of the petitioner as his lawful wife. Learned counsel further further submits that two families have amicably settled the matter and a compromise petition has been filed before the learned trial court on 19.09.2025. The petitioner is in custody since 17.09.2025 and charge-sheet has been submitted. The petitioner bears clean antecedent.

05. Learned APP for the State opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner along with submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at

Patna High Court CR. MISC. No.6579 of 2026(2) dt.04-02-2026 3/3 Hajipur/court concerned in connection with Ganga Bridge P.S. Case No. 250 of 2021, subject to the conditions mentioned in Section 480(3) of BNSS and the following conditions: (i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
