JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2019 This application, for grant of anticipatory bail, arises out of Bibhutipur P.S. Case No. 24 of 2018, disclosing offences under Sections 304/34 of the Indian Penal Code. Petitioner happens to be husband of the deceased and allegation against him is of cruelty and torture to the deceased and causing her death in connection with demand of dowry. Submission of learned counsel for the petitioner is that in fact the deceased committed suicide by hanging herself and informant of the same was also given to the informant and the petitioner has falsely been implicated in his case. Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case and the nature of allegation, I am not inclined to grant the privilege of anticipatory bail to the

Patna High Court Cr.Misc. No.6659 of 2019(2) dt.05-02-2019 2/2 petitioner rather he should surrender before the court below and pray for regular bail, which will be considered by the court below on the merit of the case.
