JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 12.12.2014 on the accusation that one country made katta, one live cartridge and one mobile were recovered from his conscious possession when he along with other accused had assembled to make preparation for committing dacoity.

Para-3 of the petition reveals that prior to institution of this case, only one criminal case i.e. Nokha P.S. Case No. 136 of 2014 for the offence punishable under Section 376/34 of the Indian Penal Code had been registered against the petitioner. Considering the aforesaid facts and circumstances as

No.11985 of 2015 (3) dt.06-07-2015 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Rohtas, Sasaram in connection with Sasaram (Agrer) P.S. Case No. 1241 of 2014.
