The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 498A, 379, 504 and 506/34 of the Indian Penal Code. The basic accusation is of torture.

It is submitted by learned counsel for the petitioner that the informant was living in adultery and she has admitted this fact by swearing affidavit. The same has been brought on record as Annexure-2. An ultimate joint photograph of informant with Aftab @ Bablu has been brought on record as Annexure-3. Considering the nature of accusation and the affidavit

Patna High Court Cr.Misc. No.31434 of 2015 (2) dt.03-08-2015 2/2 swore by the informant admitting leading adulterous life, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Dighalbank P.S. Case No. 26 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
