Let the defect (s), as pointed out by the office, be removed within a period of four weeks from today, if any. In the present case, the petitioner seeks bail in connection with Supaul P.S. Case No. 763 of 2020 registered for the alleged offences under Section 394 of the Indian Penal Code and Section 27 of the Arms Act.

The allegation against the petitioner is to have snatched an amount of Rs.22,178/- along with some other articles with the help of co-accused and firing upon the informant causing injuries in his right hand. Learned counsel for the petitioner has submitted that the petitioner is not named in the FIR. Till date, no Test

Patna High Court CR. MISC. No.6219 of 2022(2) dt.13-06-2022 2/3 Identification Parade has been conducted for identification of the petitioner in the alleged crime. Regarding criminal antecedent of the petitioner, learned counsel for the petitioner has submitted that though he is accused in five criminal cases, but he has not been named in four of them and all the four cases have been registered against unknown.

Learned counsel for the petitioner has submitted that the petitioner is in custody since 25.03.2021. Learned APP has submitted that during investigation, the name of the petitioner cropped up and he is having criminal antecedents.

Having considered the rival submissions of the parties and considering the fact that the petitioner is not named in the FIR and he is in custody since 25.03.2021, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Supaul P.S.Case No.763 of 2020, subject to the following conditions :

(i) One of the bailors will be a close relative of the petitioner, preferably one of his parents.

(iii) In case of absence for three consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
