JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 01-07-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is apprehending arrest in connection with Jhanjharpur P.S. Case No.130 of 2018 for offences under Sections 341, 323, 504, 353 and 506/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent.

The allegation against the petitioner is that he created nuisance in the campus of the college and disturbed the informant and other staff of the college. Learned counsel submits that the petitioner is a social activist and the informant compromised the matter with the petitioner. In this regard he referred to Annexure-3.

No.5552 of 2020(3) dt.01-07-2020 2/2 Considering the fact that the petitioner has no criminal antecedent and the informant has compromised the matter with the petitioner, this Court is inclined to grant bail to him. Let petitioner, above-named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate 1st, Madhubani in connection with Jhanjharpur P.S. Case No. 130 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
