Petitioner is named in the first information report but according to the prosecution case itself, altogether 13 named and some unknown persons came to take forcible possession of a land which was opposed by the prosecution party and thereafter, coaccused persons made indiscriminate firing as a result of which one Lakho Kumari sustained firearm injury and died on the spot. Admittedly, there is land dispute between the parties and it is not specific as to who caused the death of the deceased. Moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since 23.02.2015.

Patna High Court Cr.Misc. No.30338 of 2015 (3) dt.29-10-2015 2/2 Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Araria in connection with Raniganj P.S.Case No. 281 of 2014.
