The petitioner is in custody since 19.04.2016 in connection with a case registered for the offences punishable under Sections 16/17/18/20 and 21 of U.A.P. Act.
Learned counsel for the petitioner submits that the name of the petitioner has surfaced in connection with the present case only on the basis of the confessional statement of co-accused whose mobile phone was recovered and from which threat had been issued to the informant. He submits that save and except the aforesaid fact, there is no further cogent material to implicate the petitioner. He further submits with regard to the incident that though the petitioner had been acquitted in several cases and is on bail in others, the police on the basis of his criminal history, has been falsely implicating him in many such cases also, leading to the present detention.

No.23367 of 2016 (2) dt.02-06-2016 P2/2 In view of the aforementioned facts and circumstances and also because the name of the petitioner has surfaced in the confessional statement of the co-accused which has no evidentiary value, let the petitioner abovenamed be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Munger in connection with Kharagpur P.S. Case No. 08 of 2016.
