The petitioner seeks bail in a case registered under Sections 341, 323, 324, 307, 302, 34 of the Indian Penal Code. The prosecution case, in brief is that the informant's son was given knife blow and was also shot, as a result of which, he sustained injury and in course of treatment died. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 10-08-2018. Charge sheet has already been submitted. The petitioner has been falsely implicated in the present case. There is no other substantive evidence to suggest the implication of the petitioner in the present case. General and omnibus allegation has been

As per evidence of witnesses recorded in the case diary, the deceased was assaulted by knife and firing was also made upon him. The postmortem report does not indicate regarding fire arms injury on the body of the deceased. As per postmortem report, the manner of occurrence is not proved.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Laheriasarai P.S. Case No. 400 of 2018.
