The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code. As per the prosecution case, petitioner no. 1 assaulted with iron rod to the informant and there is no allegation against petitioner no. 2.

It is submitted that There is case and counter case. Both sides sustained injuries. The doctor has found the injury attributed to this petitioner no. 1 simple in nature. Petitioners claim clean antecedents.

No.6338 of 2023(2) dt.13-04-2023 2/2 Considering the facts aforesaid and nature of injury, the petitioners above-named, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IIIrd, Bettiah, West Champaran in connection with Bairiya P.S. Case No. 16 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
