Mr. Maheshwar Prasad ====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 31-10-2025 Heard learned counsel for the petitioners and learned counsel for the Informant as well as learned Additional Public Prosecutor for the State.
2. The petitioners are apprehending their arrest in a case in connection with Beldaur P.S. Case No. 136 of 2024, G.R. No. 1304 of 2024 dated 08.05.2024 registered for the offence/s punishable u/ss 341, 323, 504, 506, 307, 354, 379, 427, 327 read with section 34 of the Indian Penal Code.
3. As per the prosecution case, the petitioner and the co-accused persons along with 3-4 unknown miscreants armed with various weapons came and started abusing and the coaccused Govind Kumar assaulted the informant's son with the
Patna High Court CR. MISC. No.9970 of 2025(3) dt.31-10-2025 2/3 butt of pistol and all the co-accused persons also assaulted him with Lathi and Danda. When the informant tried to rescue, they also disrobbed her and assaulted her. It is further alleged that the co-accused Jangali Yadav also assaulted her with iron rod on her head. When the informant's husband and her daughter came to rescue, they also assaulted them and snatched Rs. 3700/- and threatened to kill them.
4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. The petitioner no. 2 is a lady. There is general and omnibus allegation against the petitioners. Nothing has been recovered from the conscious possession of the petitioners. As per the injury report, all the injuries are stated to be simple in nature. The petitioners have no criminal antecedent as stated at para 3 of the bail petition.
5. Learned counsel for the informant as well as learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.
6. Considering the aforesaid facts and circumstances of the case, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees
Patna High Court CR. MISC. No.9970 of 2025(3) dt.31-10-2025 3/3 Twenty thousand) each with two sureties of the like amount each to the satisfaction of learned court concerned, Khagaria in connection with Beldaur P.S. Case No. 136 of 2024, G.R. No. 1304 of 2024, subject to conditions as laid down under Section 482(2) of the BNSS.
7. This application stands allowed.
