The petitioner seeks bail in anticipation of her arrest in connection with Rajnagar P.S. Case No. 329 of 2019, dated 25.11.2019, (CRI Case No. 2222 of 2019) instituted for the offences under Sections 304(B) and 34 of the Indian Penal Code.

The petitioner is the sister-in-law of the deceased. The accusation against her and one of her brothers is of administering poison to the deceased.

It is a peculiar case, it has been argued, where neither the husband nor the father-in-law of the deceased have been made accused.

Patna High Court CR. MISC. No.16479 of 2021(4) dt.16-02-2022 2/2 The counsel for the petitioner has submitted that the accusation is based only on suspicion and assumptions. It has further been submitted that the post-mortem report does not disclose any definite cause of death and the viscera appears to have been preserved for further chemical examination.

The brother of the petitioner, namely, Amit Kumar Jha (brother-in-law of the deceased) has been granted regular bail by a Bench of this Court.

There is nothing in the case diary which indicates anything otherwise against the petitioner.

Considering the afore-noted aspects of the matter and taking into account the gender and the age of the petitioner, the provisional bail granted to her vide order dated 06th of January, 2022 is, hereby, confirmed. She shall remain on the same bail-bonds.

The application stands allowed.
