This application, for grant of regular bail, arises out of Mali P.S. Case No.53 of 2014, disclosing offences under Sections 379/34 of the Indian Penal Code. The petitioner is in custody since 15.09.2015. Learned counsel, appearing on behalf of the petitioner, has submitted that nothing has been recovered from his possession and the motorcycle of the informant has been recovered from the possession of co-accused, namely, Satyanarain Baitha. Patna High Court Cr.Misc. No.22988 of 2016 (2) dt.24-05-2016 2/2 that similarly circumstanced co-accused, namely, Amendra Chandravanshi @ Kallu Chandravanshi @ Amrendra Chandravanshi, has been granted regular bail by this Court vide order, dated 09.02.2015, passed in Cr. Misc. No.48535 of 2014.

Considering the submission, as above, this application is allowed. The petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Mali P.S. Case No.53 of 2014.

This is subject to the condition that the petitioner, abovenamed, shall present himself before the police/Court, as the case may be, as and when required, and in the event of failure on his part to appear before the Court, on two consecutive occasions, his bail bond shall be liable to be cancelled.
