JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-02-2020 Petitioner seeks bail in connection with Rajauli P.S. Case No. 328 of 2017, registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act. Allegation is of recovery of 2400 litres of toddy from a vehicle and petitioner is said to be the driver of the said vehicle.

Submission of learned counsel for the petitioner is that he has falsely been implicated, having no criminal antecedent and he is in custody for more than three months and charge sheet has been submitted, as such there is no chance of tampering with the evidence.

Heard learned APP also.

In view of above facts and circumstances, let

Patna High Court CR. MISC. No.8361 of 2020(2) dt.25-02-2020 2/2 petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Nawada, in connection with Rajauli P.S. Case No. 328 of 2017.
