JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 24-05-2016 Heard learned counsel for the petitioner and learned A.P.P. representing the State.

The petitioner seeks bail in connection with Sarsi P.S. Case No. 117 of 2015 registered for the offences punishable under Sections 147, 149, 341, 323, 354, 452, 504 and 506 of the Indian Penal Code.

Allegedly, the petitioner and other FIR named accused persons and 5-6 unknown entered into the house of the informant, assaulted her and her husband and made her naked by tearing her clothes.

Submission is of false implication and that prosecution story appears not probable and reliable, the petitioner has got no criminal antecedent, no offence under Sections 354 and 307 IPC is

Patna High Court Cr.Misc. No.22255 of 2016 (2) dt.24-05-2016 made out, now good sense has prevailed between the parties and the informant and her husband have filed compromise petition in the learned court below.

The learned A.P.P. opposes the prayer of bail by submitting that the husband of the informant has received fracture injury.

In the facts and circumstances stated above, the petitioner, above named, is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri. P.K. Bharti, learned Judicial Magistrate, 1st Class, Purnea in connection with Sarsi P.S. Case No. 117 of 2015 subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
