JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section47A of the Excise Act. There is recovery of near about 58 bottles of Indian made foreign liquor from possession of the petitioner. No doubt, possession of Indian made foreign liquor makes no offence but recovery of Indian made foreign liquor in huge quantity of bottles goes to show that petitioner was involved in trade of the aforesaid liquor.

Considering the above-said facts and circumstances of

Patna High Court Cr.Misc. No.22615 of 2016 (3) dt.22-06-2016 2/2 the case as well as submission of the parties, I am not inclined to release the petitioner on bail at least, at this stage and accordingly, his prayer for bail in connection with Saharsa Sadar P.S. Case No. 122 of 2016 pending in the court of learned Chief Judicial Magistrate, Saharsa stands rejected.
