JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 27-07-2019 Petitioner in the present case is looking for a direction to the respondents to decide the case of the petitioner who claims her candidature under extremely backward class for grant of licence of the fair price shop under the Bihar Targeted P.D.S. (Control) Order, 2016 (hereinafter referred to as the "Control Order, 2016") for Birpur Gram Panchayat.
Learned counsel for the petitioner submits that Annexure '4' to the writ application it will appear that one appeal has been preferred with respect to filling up of this vacancy which is pending consideration before the Collector, Madhubani. It is submitted that Collector, Madhubani (respondent no. 2) be directed to consider the said appeal and
Patna High Court CWJC No.916 of 2019(2) dt.27-07-2019 2/2 take a final decision thereon within a reasonable period. Learned counsel for the State has no objection to the same.
In the given facts and circumstances, this writ application is being disposed of with a direction to the District Magistrate, Madhubani (respondent no. 2) to look into the grievance of the petitioner, consider the pending appeal, give opportunity of hearing to all stake holders and take an appropriate decision thereon within a period of 90 days from the date of receipt/production of a copy of this order.
