The petitioners apprehend their arrest in connection with Kanti P.S. Case No.381 of 2022, registered for the offences punishable under Sections 353, 332, 333 of the Indian Penal Code and Sections 30(a)/37 of the Bihar Prohibition and Excise Act.

The petitioners and other co-accused persons are said to have attacked on the police personnel and got freed Sunil Rai and Manish Rai from the clutches of the police. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the

Patna High Court CR. MISC. No.6822 of 2023(2) dt.13-04-2023 2/3 present case. It is submitted that the petitioners have got no criminal antecedent as stated in paragraph-3 of the bail petition. It is further submitted that similarly situated co-accused, Lalita Devi and Pooja Kumari have already been enlarged on anticipatory bail by a co-ordinate Bench of this Court vide order dated 11.11.2022, passed in Cr. Misc. No.52029 of 2022. Learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioners. Petitioners are agree to deposit a sum of Rs.10,000/- (rupees ten thousand) each in the account of Bihar State Bar Council Welfare Fund, bearing Account No.31861041899, IFSC Code: SBIN0010340, High Court Campus Branch, Patna.

Taking into consideration the facts aforesaid, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Court of Special Judge Excise Act, No.2, Muzaffarpur in connection with Kanti P.S. Case No.381 of 2022, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
