The petitioner has preferred the instant application for grant of regular in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.
As per allegations in the F.I.R., four motorcycles were seized in a parked condition and on search 262.5 litres of liquor was recovered from them.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case only for the reason that he happens to be the registered owner of one of the motorcycles. No incriminating article has been recovered from his possession or his motorcycle. He is in custody since 17.12.2020 and has no criminal antecedent. Investigation in the
Patna High Court CR. MISC. No.16897 of 2021(2) dt.13-08-2021 2/2 case has concluded.
The application for bail is opposed by learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the petitioner having remained in custody for over 7 months, this Court directs the petitioner to be enlarged on bail in connection with Navinagar P.S. Case no.224 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-II-cum-Special Judge, Excise, Aurangabad.
