The petitioners seek bail in Town P.S. Case No. 619 of 2021, registered for the offence punishable under Sections 307, 323 and other allied sections of the Indian Penal Code. As per the FIR, petitioners are said to have abused the informant and thereafter, instigated co-accused Aditya Patel to assault the husband of informant. Thereafter, co-accused Aditya Patel inflicted knife blow to the husband of informant causing injury on his chest and again stabbed knife blow on his head causing cut injury and blood started oozing, thereafter he fell down.

It is submitted on behalf of the petitioners that

Patna High Court CR. MISC. No.5797 of 2022(2) dt.05-04-2022 2/2 specific allegation of assault by knife is against co-accused Aditya Patel. Only allegation against these petitioners are that they abused the informant and instigated the co-accused. Petitioners claim clean antecedent and they are in custody since 12.10.2021.

Considering the facts and circumstances of the case, the petitioners above-named, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Town P.S.
