JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Navanagar Police Station Case No. 181 of 2013 registered for the offences punishable under Sections 420, 467, 468, 471, 323, 504 and 120B of the Indian Penal Code.
Admittedly, petitioner was working as circle officer at the relevant time and issued land possession certificate in favour of co-accused Asha Kumari@ Asha Devi, who happens to be niece of the complainant and on the basis of aforesaid land possession certificate of co-accused Asha Kumari@ Asha Devi
Patna High Court Cr.Misc. No.32383 of 2014 (3) dt.09-02-2015 2/2 got sanctioned loan from the bank.
The contention on behalf of the petitioner is that petitioner issued certificate on the basis of report made by Halka Karamchari and moreover, co-accused Asha Kumari@ Asha Devi and other accused have already been granted privilege of bail. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in Navanagar Police Station Case No. 181 of 2013, subject to condition as laid down under Section 438(2) of the Cr.P.C.
