JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-02-2019 Earlier the prayer for bail of the petitioner was dismissed vide order dated 28.11.2018 passed in Cr. Misc. No. 67689 of 2018 with liberty to petitioner to renew his prayer for bail once charge is framed.

Submission of learned counsel for the petitioner is that now charge has been framed and he has been in custody since 17.07.2018 and the petitioner was only the order giver and the allegation of firing on the mother of informant is on coaccused Nunu Kumar and so far other criminal antecedents are concerned, he is on bail in all those cases.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on

Patna High Court Cr.Misc. No.6876 of 2019(2) dt.21-02-2019 2/2 furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. -II, Sitamarhi, in connection with Belsand P.S. Case No. 74 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds and further if the petitioner is again found involved in any serious offence, in that situation also, the prosecution shall move for cancellation of bail bonds of the petitioner.
