This application, for grant of anticipatory bail, arises out of Neema Chandpura Police Station Case No. 25 of 2022, dated 07.04.2022, disclosing offences under Sections 448/323/ 504/506/307/34 of the Indian Penal Code. The prosecution case, as per the First Information Report, is that while the informant was returning to her home from the temple, she was surrounded by the accused persons, including the petitioner, who assaulted her with lathi, danda, iron rod etc.

Learned Counsel for the petitioner submits that the petitioner is a lady and has falsely been implicated in this case along with other family members, six in number. He further

Referring to Annexure 2, he submits that the injury caused to the informant is simple in nature. Regards being had to the submissions made on behalf of the parties and taking into consideration the fact that both the parties are agnates, there is land dispute between them, the petitioner is a lady and the injury caused to the informant is simple in nature, I am inclined to grant the petitioner privilege of anticipatory bail.

This application is, accordingly, allowed.

Let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai, in connection with Neema Chandpura Police Station Case No. 25 of 2022, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
