The petitioners seek bail in anticipation of their arrest in connection with Kamtaul P.S. Case No. 127 of 2018 dated 21.05.2018 instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 307, 504, 506, 379 and 427 of the Indian Penal Code.
The informant is alleged to have been assaulted by all the accused persons, approximately 13 in number, and he was also divested of his personal belongings. Learned counsel appearing for the petitioners has submitted that nothing specific has been alleged
Patna High Court Cr.Misc. No.2826 of 2019(2) dt.22-01-2019 2/3 against anyone of the petitioners and under similar circumstances, some of the accused persons have been granted anticipatory bail. It has also been submitted on behalf of the petitioners that they are related to each other and deliberate attempt has been made by the informant to implicate the petitioners falsely. The informant is said to have received seven injuries out of which five injuries are opined to be simple in nature whereas the opinion with respect to two of such injuries have been kept reserved.
Learned counsel for the petitioners has submitted that in fact such injuries was caused to the informant in a road accident in which he had been injured but taking advantage of such injuries, the present case has been lodged against the petitioners. For the aforestated facts as also taking into account that the petitioners have clean antecedents, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Darbhanga in connection with Kamtaul P.S. Case No.
