This is the second attempt on behalf of the petitioner for grant of regular bail in connection with Lakhisarai P.S. Case No.385 of 2023 registered for the offence under sections 376, 354(A)(B)(C)(D), 506, 120-B of the Indian Penal Code. Earlier, the bail of the petitioner was rejected by this Court vide order dated 10.04.2024 passed in Criminal Miscellaneous No.382 of 2024.

The petitioner is accused of raping a minor girl.

It has been submitted by learned counsel for the petitioner that the petitioner is in custody since 25.05.2023

Patna High Court CR. MISC. No.8166 of 2025(2) dt.19-03-2025 2/2 and out of nine witnesses only one witness has been examined and therefore, the petitioner deserves bail on the ground of delay in trial.

Learned counsel for the informant has submitted that the prosecution will examine the remaining witnesses regularly and the trial shall not be delayed by the prosecution.

Considering the fact that the petitioner is accused of raping a minor girl and the trial has already been started, I am not inclined to grant bail to the petitioner. Accordingly, this bail application is dismissed. (Sandeep Kumar, J) pawan/- U T
