Petitioner is accused in connection with Dalsinghsarai P.S. Case No. 385 of 2014 registered under Sections 320/120B of the I.P.C.
The accusation is that on 11.08.2014 at about 1:00 pm. Md. Meraj was accompanied by the petitioner and one Md. Mokhtar. When Md. Jalal, brother of the informant, was returning at about 4:00 pm. at his house and reached at Langra Chowk, on the way, the dispoute started between Md. Jalal and Md. Meraj. In that course, Md. Meraj took the spade from the labourers who, were doing the work of construction of the house and caused injury at the head of Md. Jalal, on account of which he fell down

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that there is specific allegation against Md. Meraj who caused injury through spade to the brother of the informant, who died. The petitioner and Md. Mukhtar are said to be present there. Further it is submitted that petitioner has no criminal antecedent and is in custody since 14.03.2016.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Dalsinghsarai, Samastipur in connection with Dalsinghsarai P.S. Case No.385 of 2014. Out of two sureties, one surety must be parents or close relatives of the petitioner. (Rajendra Kumar Mishra, J) Shail/- U T
