2. The petitioner seeks bail in connection with Alamganj PS Case No.1265 of 2025 dated 05.12.2025, instituted for the offence punishable under Sections 8, 20(b)(ii) (B) of the NDPS Act.

3. The allegation is of recovery of 1.300 Kg. Ganja like substance from the house of Shambhu Kumar @ Shambhu Sah where the petitioner was also present.

4. Learned counsel for the petitioner submits that nothing has been recovered either from the conscious possession or from the house of the petitioner. The recovery has been made from the house of Shambhu Kumar @ Shambhu Sah. Further submission is that the recovered Ganja like substance from the

Patna High Court CR. MISC. No.4934 of 2026(2) dt.28-01-2026 2/2 house of Shambhu Kumar @ Shambhu Sah is slightly more than small quantity. The petitioner is in custody since 06.12.2025 having no criminal antecedents. Charge-sheet has been submitted in the case.

5. Learned APP has opposed the prayer for bail.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the District & Sessions Judge/Special Judge, NDPS, Patna, in Alamganj PS Case No.1265 of 2025.

7. The application stands allowed.
