The petitioner is apprehending his arrest in a case registered under Sections 366A/34 of the Indian Penal Code. The prosecution case, in brief, is that in course of going computer class, the informant's daughter was allured and taken away by the accused persons for the purpose of marriage. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been falsely implicated in the present case. The victim has been examined u/S 164 Cr.P.C. in which, she has admitted that she had left the house out of her own sweet will. Patna High Court Cr.Misc. No.9897 of 2019(2) dt.19-02-2019 2/2 accused namely Vivek Mandal Bishek with similar allegation has been granted anticipatory bail by a coordinate bench of this court vide order dated 02-08-2018 passed in Cr. Misc. No. 45451 of 2018.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate/concerned court, Banka in connection with Amarpur P.S.
