2. Heard learned counsel for the petitioners, informant and learned A.P.P. for the State.
3. Petitioners seeks regular bail in connection with Maharajganj P. S. Case No. 586 of 2024 registered for the
Patna High Court CR. MISC. No.7127 of 2026(3) dt.10-04-2026 2/3 offences punishable under Sections 103, 238, 3(5) of the Bharatiya Nyaya Sanhita.
4. As per F.I.R.,on 3.12.2024, these petitioners strangulated granddaughter of the informant, namely, Sabera Kumari to death and disposed of her dead body with a view to disappear the evidence.
5. Learned counsel for the petitioner submits that petitioners are innocent and have committed no offence. Informant is not an eye witness to the occurrence. As a matter of fact, Sabera Kumar (deceased) felt abnormality in her health and accordingly, these petitioners rushed to Medwin Health Care, Gharbharan Market, in front of Gaushala Gate, Siwan where she was primarily treated and was referred to another hospital for better treatment but unfortunately, on the way to the hospital, she died. Petitioners claim clean antecedent and are in custody since 18.11.2025.

Learned A.P.P. for the State as well as learned counsel for the informant vehemently opposed the bail application and submitted that petitioners are named in the F.I.R. with specific accusation that these two petitioners strangulated the deceased. During investigation, elder granddaughter of the informant, namely, Khushi Kumari and her
Patna High Court CR. MISC. No.7127 of 2026(3) dt.10-04-2026 3/3 brother, namely, Ayush Kumar have supported the prosecution case.
7. Considering the nature of accusation and gravity of the offence, prayer for bail of the petitioners is rejected.
8. However, since petitioners are in custody since 18.11.2025, Trial Court is directed to expedite and conclude the trial, preferably, within a period of one year from the date of receipt/production of copy of this order.
