The petitioner is accused in connection with Maharjganj P.S. Case No. 297 of 2014, registered under Section 413, 414/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that it would appear from the F.I.R. itself that Police apprehended Mannu Mian and Jitan Yadav with motorcycle and they disclosed regarding handing over the said motorcycle by this petitioner, except the confessional statement there is nothing against the petitioner to show his involvement in the present case. Further submission is that similarly situated co-accused, namely, Jitan Yadav @ Jitan Choudhary has already been granted privilege of bail by a co-ordinate Bench of this Court
Patna High Court Cr.Misc. No.21885 of 2016 (3) dt.27-07-2016 2/2 vide order dated 27.05.2015 passed in Criminal Misc. No. 12622 of 2015. Further submission is that petitioner having no criminal antecedent is in custody since 29.03.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in connection with Maharajganj P.S. Case No. 297 of 2014. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
