The petitioner is in custody since 20.09.2021 in connection with Paroo P.S. Case No. 371/2021 registered for the offence punishable under Sections 363/366(A)/34 of the Indian Penal Code.

It has been submitted by learned counsel for the petitioner that no overtact has been alleged against the petitioner by the victim girl in her statement recorded under Section 164 Cr. P.C. But the same cannot be verified at this stage because the statement has not been supplied to the petitioner. This application is disposed of with a direction to the Court below that if the petitioner files an application again for bail, the Court below will consider the statement of the girl in details and if it finds that there is no allegation of sexual assault against the petitioner then the Court below will be at liberty to

Patna High Court CR. MISC. No.6388 of 2022(2) dt.25-05-2022 2/2 pass an order in accordance with law.
