The petitioner in the present case is seeking anticipatory bail in connection with Motipur P.S. Case No. 303 of 2019 registered for the offences punishable under Sections 341, 323, 307, 379, 504/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. It is submitted that though there is allegation against the petitioner for giving a single rod blow on the head of the informant but the injury has been found to be simple in nature. It is further submitted that the parties are gotiya having land dispute and in that background the scuffle took

Learned APP for the State has opposed the prayer for anticipatory bail of the petitioner.
Having regard to the facts and circumstances of the case wherein there is an allegation against the petitioner that he had assaulted by an iron rod on the head of the informant and the same being on the vital part causing injury, I am not inclined to grant privilege of anticipatory bail to the petitioner. His prayer for anticipatory bail is thus, refused.
In case the petitioner surrenders and prays for regular bail before the learned court below within a period of four weeks from today, his prayer for regular bail shall be considered on its own merit without being prejudiced by the order of this Court.
