The petitioner seeks bail in connection with Sakatpur P.S. Case No. 80 of 2022 dated 22.09.2022 registered for the offence punishable under Section 392 of the Indian Penal Code. As per allegation, petitioner along with the co-accused in the drunken position snatched motor-cycle, mobile phone and gold chain from the possession of the informant. Learned counsel for the petitioner submits that petitioner is a co-villager and due to previous enmity he has been falsely implicated in this case. There is no recovery of the said stolen motor-cycle from the conscious possession of the petitioner and the petitioner is in jail custody since 23.09.2022. Learned counsel for the petitioner further submits that
Patna High Court CR. MISC. No.11771 of 2023(2) dt.15-05-2023 2/2 similarly situated co-accused Amit Kumar Choudhary has been granted bail by a Co-ordinate Bench of this Court vide order dated 02.05.2023 in Cr. Misc. No. 5078 of 2023. Learned APP appearing for the State has opposed the prayer for bail.
Considering the facts and circumstances of the case and submission of learned counsel for the parties, let the petitioner above named, be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Sakatpur P.S. Case No. 80 of 2022.
