1. This is an application under Section 102 of the Juvenile Justice (Care and Protection of Children) Act, 2015, challenging legality, validity and propriety of the order, dated 19th of September, 2023, whereby and whereunder the learned Additional District & Sessions Judge 1st-cum-Special Judge (Children Court) rejected the prayer for bail of the CICL, considering his nature of offence and SIR submitted by the Jurisdictional Probation Officer.

2. This Court has perused the impugned order.

3. The allegation against the CICL is that he forcibly took away a minor victim when she came out of her room at about 11:00 P.M. and brought her by the side of a river and committed penetrative sexual assault.

4. The nature of the allegation does not inspire this Court to invoke Section 12 of the Juvenile Justice (Care and Protection of Children) Act, 2015.

5. Therefore, I do not find any illegality or irregularity in the impugned order.

6. It is submitted by the learned Advocate for the petitioner that the trial of the case is going on.

7. Since the petitioner is in an Observation Home as of 17.06.2023, this Court directs the conclusion of the trial of the case expeditiously and preferably within 6 months from the date of communication of this order.

8. With the above direction, the instant criminal revision is disposed of.
