The petitioner has preferred this application for grant of regular bail in a case registered under sections 414 and 34 of the Indian Penal Code and sections 20 and 22 of the N.D.P.S. Act.

As per the prosecution case, 100 gms of Charas, 1 kg of Ganja as also 3 purias of Ganja was recovered from the possession of the petitioner.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession. He has been falsely implicated in the case. He has no criminal antecedent and is in custody since 25.9.2020. Chargesheet has been submitted in the case.

The application for bail is opposed by learned A.P.P.

Patna High Court CR. MISC. No.12584 of 2021(4) dt.28-09-2021 2/2 for the State.

Having heard learned counsel for the parties and taking into consideration the recovery of 100 gms of Charas and 1 kg of Ganja from the possession of the petitioner, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.
