Heard learned counsel for the petitioner and the learned APP for the State.
This is an application for regular bail on behalf of the petitioner for the offences alleged under section 392 and 411 of the Indian Penal Code.
As per allegation, two miscreants dashed the motorcycle of the informant and took away Rs 2,50,000/- and one mobile phone from the informant and fled away.
Learned counsel for the petitioner has submitted that the name of the petitioner has figured in the confessional statement of co-accused Rahul Kumar, who has been granted bail vide order dated 5.2.2021 in Cr. Misc. no. 34315 of 2020. Another co-accused Sanoj
Patna High Court CR. MISC. No.6256 of 2022(2) dt.25-05-2022 2/2 Kumar Paswan, whose name was figured in the confessional statement of co-accused Rahul Kumar has also been granted bail in Cr. Misc. no. 12844 of 2021 and the case of the petitioner is on similar footing as that of co-accused Sanoj Kumar Paswan. The petitioner is in custody since 03.12.2021.
Considering the clean antecedents and period of custody of the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar in connection with Korha P.S. Case no. 92 of 2020, subject to the following conditions:- 1.
The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. 2.
If the petitioner is found involved in future in similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) s.hassan/- U T
