JUSTICE SATYAVRAT VERMA ORAL ORDER 29-09-2022 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State. In compliance of the order dated 30.08.2022, the S.H.O. of the concerned P.S. is present physically along with the case diary and submits that the I.O. of the case was on leave as such in his place, in compliance of the order, he has come. The S.H.O. based on the investigation as recorded in the case diary with regard to the call details has submitted that no doubt the deceased used to talk to this petitioner but then during the course of investigation, it has come that the son-inlaw of the informant also used to talk to her and the talk between them was frequent.

At this stage, the learned counsel for the informant

Patna High Court CR. MISC. No.6237 of 2022(3) dt.29-09-2022 2/2 submits that he has instruction not to oppose the anticipatory bail of application of the petitioner.

Considering the submissions made by the learned counsel for the informant and also the fact that during the course of investigation no material has come which could connect the petitioner with the offence as such the petitioner, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Saraiya P.S. Case No. 18 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

The personal appearance of the S.H.O., Saraiya P.S. is hereby dispensed with.
